What Florida homeowners should know about pool permits, barrier rules, builder licensing and HOA approval before signing with a Tampa Bay-area builder. Laws and city pages are linked at the bottom. This is a summary, not legal advice; your city's building department has the final word. Checked October 23, 2026.
Florida's pool safety law (Chapter 515)
- To pass final inspection, a new residential pool must have at least one safety feature: a barrier meeting section 515.29, an approved safety cover, exit alarms on doors and windows with direct access to the pool, self-closing and self-latching doors with the release at least 54 inches above the floor, or a pool alarm meeting ASTM F2208[7].
- Failing to comply is a second-degree misdemeanor[7].
- A barrier must be at least 4 feet high on the outside, with no gaps or features that help a child climb over; gates must open outward, self-close and self-latch, with the release on the pool side[8].
- A wall of the house can be part of the barrier if it has no door or window opening onto the pool area[8].
Permits in Tampa
- Angi says Tampa requires a Swimming Pool and Spa Permit for building, altering or repairing in-ground and above-ground pools 18 inches deep or more, plus some or all of: electrical, plumbing, site clearing/tree removal, stormwater, fence or masonry wall, and aluminum work permits[1].
- St. Petersburg, Clearwater, Sarasota, Bradenton and the counties have their own permit offices. Ask yours, and your HOA, before you sign.
Florida licensing: what a pool builder needs
- Pool/spa contractors are licensed by the state. Florida Statutes 489.105 defines commercial pool/spa, residential pool/spa and swimming pool/spa servicing contractors (the residential class covers building, repairing and servicing residential pools and spas), and separates certified contractors (licensed by the state to work anywhere in Florida) from registered contractors (allowed to work only in the local jurisdictions where they hold a local competency license)[2].
- License prefixes. On the DBPR license search, check the license type and whether it is certified (statewide) or registered (local only); most builders listed here publish numbers beginning with CPC[3].
- Check before you sign. Look the builder up on the DBPR license search and confirm the license is current[3]. Where a builder prints its license number on its website, it is on the company's profile here, copied as published.
Permit cost and timing (national)
Angi puts permits at $450–$1,800 nationally[4] and permit time at 2–6 weeks, varying by city[6].
HOA approval
HOA rules come from each association's own governing documents, not from one state rule, so we don't summarize them here. Practical steps:
- Ask your HOA for its architectural review (ARC) application, what it needs (site plan, fence, equipment location) and how long review takes.
- Agree in writing who submits the HOA application, you or the builder, and don't let work start before written approval.
- Make sure the quote includes the barrier your city requires, and ask whether the HOA has its own fence rules.

Frequently asked questions
Do I need a permit to build a pool in Florida?
Florida law requires a new residential pool to have at least one listed safety feature to pass final inspection[7]. Ask your city or county what permit to file.
How high does a pool fence have to be in Florida?
Florida Statutes 515.29 sets at least 4 feet on the outside[8].
Who handles HOA approval?
Your HOA's own documents set the process. Agree in writing whether you or the builder submits the application, and don't start work before written approval.
